This document, which contains the Terms and Conditions of Use of the DinoShop.ro website, must be accepted by every visitor or user of the DinoShop.ro Site, meaning any natural person and/or legal entity who accesses and/or purchases/acquires/uses Products and/or Services from DinoShop.ro.

Using or merely visiting the dinoshop.ro domain and/or its subdomains implies acceptance of the Terms and Conditions in the form in which they are presented on the Site.

DinoShop.ro, through its administrator, operates in accordance with Law No. 365/2002 on electronic commerce, as amended by Law No. 121/2006, Government Ordinance No. 130/2000 on consumer protection in the conclusion and performance of distance contracts, and Emergency Government Ordinance No. 34/2014 on consumer rights in contracts concluded with professionals, and is subject to all applicable legal provisions in Romania.

Contract – an Order confirmed by the Seller, whereby the Seller agrees to sell and deliver Products and/or Services and the Client agrees to purchase, receive, and pay for the respective Products and/or Services; the Contract is concluded on the basis of these Terms and Conditions and implies their acceptance by the Client;

Courier – any public or private legal entity providing express courier services;

Terms and Conditions – this document, which serves as a contract between the User/Client and the Seller;

3. Contractual documents

By placing an electronic or telephone order on DinoShop.ro, the Client agrees to the form of communication (by telephone or e-mail) used by the Seller to conduct its operations.

The Contract enters into force upon confirmation of the Order by the Seller. Acceptance of the Order by the Seller shall be deemed completed when the Seller provides the Client with electronic confirmation (by e-mail) or verbal confirmation (by telephone), without requiring any acknowledgement of receipt from the Client. The general Terms and Conditions of Sale shall form the basis of the Contract thus concluded. At no time shall the Seller consider an unconfirmed order to have the value of a Contract.

4. Online Sales Policy

Access to place an Order is permitted to any User. For justified reasons, DinoShop.ro reserves the right to restrict the Client/User's access to place an Order and/or to some of the accepted payment methods, if it considers that, based on the Client/User's conduct or activity on the Site, their actions could in any way harm DinoShop.ro. In any of these cases, the Client/User may contact contact@dinoshop.ro to be informed about the reasons that led to the application of the aforementioned measures.

Communication with DinoShop.ro may take place through interaction with the Site, by posting opinions regarding Products, or by contacting the addresses mentioned in the “Contact” section. Opinions or messages containing insults or inappropriate language will be removed from the Site or ignored. The Seller is free to manage the information received without being required to provide justification for doing so.

The information presented on DinoShop.ro is for informational purposes and may be modified by the Seller without prior notice. Furthermore, for reasons related to space and the coherence of the information structure, Product descriptions may be incomplete; however, the Seller makes every effort to present the most relevant information in order to facilitate the optimal purchase and use of the Product.

In the event of an unusually high volume of traffic originating from an internet network, DinoShop.ro reserves the right to require users to manually enter CAPTCHA validation codes in order to protect the information available on the Site.

5. User Registration

To create an account on the DinoShop.ro Site, the User is required to use a valid e-mail address. DinoShop.ro may refuse a registration request if it determines that false or inaccurate information has been provided or that the Site’s services are being used in a manner inconsistent with normal usage practices.

6. Ordering

To place an Order, the User must agree to the DinoShop.ro Terms and Conditions. The User is not required to have an account, but those who choose to create one will benefit from a saved list of billing/delivery addresses, an order history, as well as other features that will facilitate future Orders.

The online Order shall be considered accepted only after the User receives telephone or electronic confirmation from a DinoShop.ro operator regarding stock availability and the possibility of delivering the ordered Products.

The Client must confirm the Order by telephone or electronically within a maximum of 5 (five) calendar days from the date on which it was placed. If the Client cannot be contacted or does not confirm the Order within this period, despite reasonable attempts by DinoShop.ro to make contact, the Order may be cancelled.

7. Product Prices. Payment Methods

All Product prices are expressed in RON and are valid at the time they are ordered. Prices do not include VAT, as S.C. MI-GO CONCEPT DESIGN S.R.L. is not registered for VAT. Prices do not include any green stamp fee or shipping fee; any applicable tax or additional cost will be displayed separately before the Order is completed.

DinoShop.ro will issue the Client an invoice for the delivered Products, and the Client is required to provide all information necessary for issuing the invoice in accordance with the applicable legislation. If the Client fails to provide the required information or provides incomplete or incorrect information, DinoShop.ro reserves the right not to process and/or fulfill the Order until complete and accurate information is provided.

Payment for the Products may be made using the following methods:

Online card payment, through the online payment processor NETOPIA Payments, which ensures the security of financial transfers and personal data;
Cash on delivery (available exclusively for domestic orders) – payment in cash to the Courier upon delivery or by card at a Sameday Point/Easybox, depending on the delivery method selected when placing the Order. This payment method is not available for international orders;
Payment by bank transfer, only after confirmation of the Order and the payment method by a DinoShop.ro operator. After placing the Order using this payment method, the Client will be contacted as soon as possible for confirmation and to establish the transfer details. The Products will be delivered after the amount representing the total value of the pro forma invoice issued by DinoShop.ro for the ordered Products has been credited to the account.

8. Delivery Information

8.1. Domestic Delivery Methods (Romania)

- - Courier delivery – The ordered Products will be delivered by courier anywhere in Romania. The courier delivery fee is 24.99 RON for domestic destinations covered by the courier company’s network, and the estimated delivery time is 1–3 business days from the moment the Order is confirmed by DinoShop.ro by telephone or electronically. For locations outside the courier company’s network, the Client will be contacted by a DinoShop.ro operator to be informed of any additional shipping fee and to reconfirm the Order under the new conditions. DinoShop.ro will send the Client the AWB tracking number by SMS or e-mail when the parcel is handed over to the courier company.
  - Sameday Point/Easybox pickup – The ordered Products will be delivered by the Sameday courier company to a Sameday Point/Easybox within approximately 1–3 business days from the moment the Order is confirmed by DinoShop.ro by telephone or electronically. The delivery fee for Sameday Point/Easybox pickup is 14.99 RON. An Order delivered to a Sameday Point/Easybox must be collected personally by the Client within 36 hours for any Order delivered on Monday, Tuesday, Wednesday, Thursday, or Sunday, within 72 hours for an Order delivered on Friday, and within 48 hours for an Order delivered on Saturday. DinoShop.ro will send the Client the AWB tracking number by SMS when the parcel is handed over to the courier company.

For Orders of at least 299 RON, delivery is free of charge for domestic destinations covered by the courier company’s network.

If the Courier Delivery (Romania) method is selected, the courier will contact the Client by telephone to mutually agree on the exact day and time of delivery. Once agreed, the delivery time slot may subsequently be changed only with the Courier’s consent. The Client undertakes to be present at the specified delivery address during the time slot agreed with the Courier; otherwise, the Client shall bear the shipping fee associated with a possible new delivery attempt. The Courier is not an employee of DinoShop.ro and is not authorized to open the parcel.

In the case of opting for the delivery method Pick-up Sameday Point/Easybox, the Client will be informed of the delivery status by the Sameday courier company via SMS/WhatsApp messages, the Sameday mobile application, and/or the Sameday website. The Client has 36 hours to collect any Order delivered on Monday, Tuesday, Wednesday, Thursday, or Sunday, 72 hours for an Order delivered on Friday, and 48 hours for an Order delivered on Saturday. If the Client is unable to collect the Order within these timeframes, the storage period at the Sameday Point/Easybox may be extended by up to 7 days from the moment the parcel arrives at the delivery point, subject to a fee, through the Sameday mobile application.

If the Client fails to collect the Order for reasons not attributable to DinoShop.ro, DinoShop.ro reserves the right to refuse future Orders from the Client or to restrict the payment methods available to the Client (e.g. online card payment only).

8.2. International Delivery Methods (European Union)

For customers within the European Union, DinoShop.ro has implemented a delivery system based on geographical zones. The exact delivery cost varies depending on the destination country and the selected delivery method and is calculated automatically at checkout. All international shipments include a tracking number. Countries are divided into the following delivery zones:

EU Zone 1 (Bulgaria, Croatia, Czechia, Greece, Hungary, Poland, Slovakia, Slovenia): Express Delivery via DPD, with an estimated delivery time of 3–5 business days.
EU Zone 3 (Belgium, Denmark, Estonia, France, Latvia, Lithuania, Luxembourg, the Netherlands, Spain): Express Delivery via DPD (estimated delivery time 3–5 business days) or Standard Delivery via Romanian Post (estimated delivery time 7–14 business days).
EU Zone 3 (Belgium, Denmark, Estonia, France, Latvia, Lithuania, Luxembourg, Netherlands, Spain): Express Delivery via DPD (estimated delivery time 3-5 working days) or Standard Delivery via Romanian Post (estimated delivery time 7-14 working days).
EU Zone 4 (Finland, Portugal, Sweden): Express Delivery via DPD (estimated delivery time 3–5 business days) or Standard Delivery via Romanian Post (estimated delivery time 7–14 business days).
EU Zone 5 (Cyprus, Malta, Ireland): Standard Delivery via Romanian Post, with an estimated delivery time of 7–14 business days.

For international Orders, cash on delivery is not available; the Client must choose either online card payment or bank transfer. The free delivery promotion for Orders over 299 RON does not apply to deliveries outside the territory of Romania.

Delivery shall be deemed completed by DinoShop.ro when the ordered Products are handed over to the Client at the address selected by the Client when placing the Order. Handover means signing the transport document provided by the Courier to acknowledge receipt.

9. Product Returns (Right of Withdrawal)

In accordance with Emergency Government Ordinance No. 34/2014 on consumer rights (which transposes European Union rules), Products purchased online from DinoShop.ro may be returned without providing any specific reason within 14 calendar days from the date on which the Client, or a third party indicated by the Client, takes physical possession of the Products.

Products purchased from the DinoShop.ro premises or at fairs are not covered by the 14-day right of withdrawal, as they could be inspected directly before purchase and do not constitute distance selling.

Reduction in the value of returned Products: The Client is responsible only for any reduction in the value of the Products resulting from handling other than that necessary to establish their nature, characteristics, and functioning. Since DinoShop.ro Products (e.g. fossils) are items intended for display, any damage or signs of wear occurring while they were in the Client’s possession will be attributed to the Client, resulting in the retention of a proportionate amount from the refund (which may amount to up to 100% of the Product’s value if the Product is destroyed or compromised).

To return one or more Products, the Client is requested to follow the steps below:

- - The customer will inform DinoShop.ro about their decision to withdraw using the return form (the legal model) found at the address. https://dinoshop.ro/formular-returnare-produs/ (or by any other unequivocal statement). DinoShop.ro will confirm the receipt of the return request within 2-3 working days (excluding the announced leave periods) and will communicate the shipping instructions;
  - In order to be within the legal deadline, the information regarding the withdrawal must be sent by the Customer before the expiry of 14 calendar days from the physical receipt of the Products. The store's holiday periods do not affect this deadline;
  - After notifying DinoShop.ro of the decision to return the Products, the Client is required to send the Products back (by courier or by personal delivery) within no more than 14 days from the date on which the withdrawal request was communicated;
  - Costurile directe legate de returnarea Produselor cad în sarcina și vor fi suportate integral de către Client. DinoShop.ro nu poate fi făcut răspunzător pentru deteriorarea Produselor în timpul livrării de retur sau pentru pierderea coletului. Clientul este rugat să aibă foarte mare grijă la împachetarea Produselor şi să asigure conţinutul pachetului la valoarea integrală a acestuia. În cazul fosilelor se recomandă împachetarea individuală a fiecărui specimen într-un material protector (spre exemplu folie cu bule) şi aşezarea într-o cutie de carton solidă, în care specimenele să stea în poziţie fixă, să nu se lovească unele de altele şi să nu aibă contact direct cu pereţii cutiei;
  - If the Products are sent by courier, the Client is requested to write the return request number on the shipping document (AWB) and then send the AWB number to contact@dinoshop.ro. Parcels sent cash on delivery (a shipping method under which the recipient is required to pay the amount due upon receipt) will be automatically refused and will not be accepted by DinoShop.ro;
  - After the Products arrive at the DinoShop.ro premises, they will be inspected by an expert to determine whether their condition shows any signs of damage occurring while in the Client’s possession or during return transport. The Client will be contacted and informed of the outcome of the inspection and, where applicable, of the assessed reduction in the value of the Product;
  - DinoShop.ro will refund the value of the Products, including the initial costs corresponding to standard delivery, within a maximum of 14 (fourteen) calendar days from the date on which it is informed of the decision to withdraw. In accordance with the law, DinoShop.ro reserves the right to withhold the refund until the returned Products are received or until the Client provides proof (e.g. a valid AWB) that the Products have been shipped. The refund will be made using the same payment method used for the initial transaction, unless another method has been expressly agreed upon.

In the event of abuse (repeated unjustified returns), DinoShop.ro reserves the right to refuse to fulfill future Orders placed by the Client.

10. Refusal, Suspension and Cancellation of Orders

DinoShop.ro reserves the right to refuse to process an Order, to suspend its processing or, where applicable, to cancel the Order, exclusively on the basis of objective and justified reasons and in compliance with applicable legislation.

Without limitation, the following may constitute justified reasons:

a) The Client does not provide all the information necessary for processing the Order, invoicing, payment, or delivery, or the information provided is incomplete, incorrect, outdated, or does not allow the Client to be identified and/or the delivery to be carried out;

b) DinoShop.ro reasonably requests that the Client clarify or correct information necessary for processing the Order, and the Client does not respond to the request or refuses to provide the necessary information;

c) each Order placed on DinoShop.ro is subject to telephone or electronic confirmation by the Client, such confirmation representing a mandatory step for continuing the processing of the Order. If the Client does not confirm the Order by telephone or electronically within 5 (five) calendar days from the date on which it was placed, despite reasonable attempts by DinoShop.ro to contact the Client using the contact details provided, DinoShop.ro reserves the right to cancel the Order;

d) payment for the Order is not authorized, is refused by the payment processor or financial institution, is not completed, is cancelled, or there are reasonable indications of unauthorized use of a payment method;

e) there are objective and reasonable indications of fraud, attempted fraud, identity theft, unauthorized use of another person’s data, or any other unlawful activity related to the Order;

f) the Client uses the Site or DinoShop.ro Services fraudulently, abusively, or in violation of these Terms and Conditions or applicable legislation;

g) there is a documented history of the Client placing Orders in bad faith, including fictitious Orders, the use of false information, repeated and unjustified refusals to accept dispatched parcels, failure to pay amounts due, or other conduct that has caused or is likely to cause harm to DinoShop.ro;

h) there are reasonable grounds to believe that an Order is placed for the purpose of defrauding, disrupting, or adversely affecting the operations of DinoShop.ro, or for unlawfully obtaining benefits, discounts, vouchers, promotions, or other commercial advantages;

i) the Client attempts to circumvent quantity limits, the conditions of a promotional campaign, or other rules clearly communicated for the purchase of certain Products, including by using multiple accounts, identities, addresses, or successive Orders;

j) the quantity ordered is unusually large in relation to the retail nature of the Site, and there are reasonable grounds to believe that the purchase is being made for resale, where DinoShop.ro has established and communicated reasonable limits regarding the quantity that may be purchased;

k) the ordered Product is no longer available in stock, the displayed stock level has been affected by a system error, or there is an objective impossibility of restocking the Product;

l) as a result of an obvious technical or material error, clearly incorrect information regarding the price, characteristics, availability, discount, or other essential elements of the Product has been displayed on the Site, while respecting the Client’s rights provided by law;

m) delivery cannot be made to the address indicated by the Client, delivery services are not available in the respective area, applicable legal or logistical restrictions exist, or the Client requests a delivery method that DinoShop.ro is unable to provide;

n) fulfillment of the Order would result in a breach of a legal provision, a measure imposed by a competent authority, or a legal obligation applicable to DinoShop.ro;

o) the Product has been withdrawn from sale, there is a safety alert, an identified non-conformity, or any other reason relating to the protection of consumer health or safety that legally or reasonably prevents its sale;

p) there is a technical, operational, or system error that makes it impossible to process or fulfill the Order correctly;

q) the Client engages in seriously abusive, threatening, fraudulent, or unlawful conduct toward DinoShop.ro employees, representatives, collaborators, or partners, insofar as the refusal to continue the commercial relationship is objectively justified and proportionate to the circumstances;

r) there are other situations in which the refusal or cancellation of the Order is objectively justified by a legitimate purpose, and the measure adopted is necessary and proportionate to the specific circumstances.

Telephone or electronic confirmation is mandatory for every Order placed on DinoShop.ro and represents a necessary step for continuing its processing. For this purpose, DinoShop.ro may contact the Client using the contact details provided when placing the Order.

If the Order is cancelled due to the lack of telephone confirmation, any amounts paid in advance by the Client will be refunded in accordance with applicable legislation and, where appropriate, using the same payment method used by the Client, except where the law or an agreement between the parties permits another method.

The mere exercise by a consumer of their legal rights, including submitting a complaint, referring a matter to a competent authority, requesting the application of the statutory warranty, or exercising the legal right of withdrawal from a distance contract, does not, in itself, constitute grounds for refusing future Orders.

DinoShop.ro will not refuse an Order or restrict a Client’s access to Products or Services on discriminatory grounds or on any other grounds for which such treatment is prohibited by applicable legislation.

Where circumstances allow, DinoShop.ro may request that the Client remedy the situation preventing the processing of the Order before the Order is cancelled.

If an Order is refused or cancelled, the Client will be informed using the contact details provided, where such notification is possible and does not conflict with legal obligations, fraud prevention measures, or security requirements.

If the Client has already paid amounts relating to an Order that can no longer be fulfilled, those amounts will be refunded in accordance with applicable legislation and, where appropriate, using the same payment method used by the Client, except where the law or an agreement between the parties permits another method.

DinoShop.ro may temporarily suspend the acceptance of new Orders from a Client where there are objective and justified reasons among those set out above. Such a measure will be applied proportionately to the nature and seriousness of the situation and will not affect rights already acquired by the Client under the law or under contracts already concluded.

11. Warranty

DinoShop.ro Clients benefit from all rights granted by the legislation in force – Law No. 449/2003 on the sale of products and associated guarantees, and Romanian Government Ordinance No. 21/1992, as republished, on consumer protection. The Seller’s liability is assumed in accordance with the provisions of Article 16 of Law No. 449/2003 and Article 16-2 of Law No. 449/2003. Reimbursement of the Product’s value shall be made under the conditions set out in Article 11 of Law No. 449/2003, as well as Articles 14 and 15 of Government Ordinance No. 21/1992, as republished.

It is recommended that the receipt or tax invoice be retained for any complaints regarding the purchased Products that may be made during the warranty period.

Complaints should be sent to the e-mail address contact@dinoshop.ro and should include the identification details of the Client submitting the complaint, an explanatory description, supporting photographs of the unsatisfactory Product (if applicable), a copy of the proof of purchase (invoice or fiscal receipt), as well as contact details (telephone number, e-mail address, Order number, etc.). The maximum period for resolving complaints is 14 calendar days.

The warranty provided by DinoShop.ro varies depending on the Product category.

11.1. Fossil Product Warranty

For the fossil specimens, a guarantee of legal compliance is granted in accordance with Law No. 449/2003, so that any Product that is considered non-compliant (if it does not have the same qualities and/or characteristics as described on the Website) https://dinoshop.ro/, If the product does not match the photos on the Site or does not have the qualities and characteristics listed on the invoice), it can be replaced within the limits of the available stock. Otherwise, DinoShop.ro will refund the product’s value.

The warranty does not cover natural imperfections of fossil specimens, normal wear and tear and/or damage caused by theft, loss, misuse, accidents, careless handling or improper storage. The warranty does not apply to specimens that have been repaired by the consumer.

It is important to understand that each fossil specimen is unique and may be incomplete or may display imperfections (scratches, chips, fractures). These are the result of the specimen’s natural transformation and wear over millions of years and/or, in certain cases, an inherent result of the extraction process. Many specimens may also show repairs carried out after extraction (such as glued sections or restorations). These are also normal, given that the specimens are tens or hundreds of millions of years old, are often discovered in fragments, and are subsequently reconstructed.

DinoShop.ro provides detailed photographs of each individual fossil, in which any defects and/or repairs and/or natural characteristics can be observed. DinoShop.ro assumes no responsibility for the Client’s lack of attention when selecting a specimen or lack of experience in choosing the specimen, and such matters are not covered by the conformity warranty.

The dimensions of fossils may vary from less than one centimetre to several tens of centimetres or more. DinoShop.ro provides the approximate dimensions of each specimen in the Product description, and at least one photograph in the Product gallery shows the specimen placed next to a ruler marked in centimetres.

It is the User’s responsibility to take into account the dimensions of the specimen stated on DinoShop.ro and to carefully review all photographs of the specimen in order to form an accurate impression of its size before placing the Order.

General Guidelines for the Display, Care, Transport, and Storage of Fossils:

- - Handling – these are natural, fragile specimens that are tens of millions of years old and require careful handling to avoid damage; specimens must not be dropped on the ground or subjected to any other form of impact.
  - Display and Storage – fossils must be protected from moisture and extreme temperatures and kept in places where they cannot fall or be struck.
  - Transport – when transporting fossils, it is recommended that each specimen be individually wrapped in protective material (bubble wrap) and placed in a container lined with foam or another soft protective material, in a fixed position so that it cannot strike other specimens or the walls of the container. Cotton wool is not recommended for fossils with fragile protrusions, as these may become caught in the cotton wool and subsequently break.
  - Cleaning/Washing Fossils – fossils may be damaged during cleaning. DinoShop.ro does not recommend cleaning or washing fossils, and any such action is undertaken at the Client’s own risk.
  - Contact with Chemicals – fossils should not be exposed to any type of chemicals, detergents, sprays, perfumes, or other cosmetic products.

Specific Guidelines for the Care and Storage of Fossils:

- - Amber – amber should be protected from prolonged exposure to sunlight, and it is recommended that it be stored in a dark place. Periodic handling by hand is also recommended in order to provide it with a natural protective oily coating.
  - Pyritized Specimens – pyritized specimens must be especially protected from moisture, otherwise they may rust. It is recommended that they be stored away from other pyritized specimens.

11.2. Costume Jewelry Warranty

The costume jewelry sold by DinoShop.ro is made from non-precious materials. It may or may not contain fossil specimens. If it contains fossil specimens, the Client is requested to read Section 10.1 of these Terms and Conditions, dedicated to fossils, for information regarding their warranty and care.

DinoShop.ro undertakes to provide a 14-calendar-day commercial warranty for any costume jewelry purchased from DinoShop.ro, from its registered office, or at fairs, which becomes damaged through no fault of the Client and under normal conditions of use. If the jewelry cannot be repaired, DinoShop.ro will replace it or refund its value within 14 calendar days.

Attention! Fossil specimens incorporated into certain costume jewelry sold by DinoShop.ro are not covered by the 14-day commercial warranty. The commercial warranty for costume jewelry applies only to cords, clasps, ornaments, or artificial charms. Fossil specimens benefit from the statutory conformity warranty, in accordance with Section 10.1, and, due to their age, any potential damage occurring while being worn is a risk assumed by the Client. For further details, the Client is requested to read Section 10.1 of these Terms and Conditions, dedicated to fossils.

The warranty does not cover normal wear and tear and/or damage caused by theft, loss, improper use, accidents, negligent handling, or improper storage. The warranty does not apply to Products that have been repaired by the Client.

The commercial warranty for costume jewelry does not apply in the following cases:

- - Improper Use – jewelry must be opened and closed carefully, must not be forced, must not be worn while sleeping, and must not be worn during strenuous physical activities.
  - Improper Storage – the materials from which the jewelry is made (alloys, textile cords, etc.) may be damaged by contact with water, storage in humid environments, or prolonged contact with natural perspiration (strenuous physical activities or sports should not be performed while wearing this jewelry).
  - Contact with Chemicals – jewelry may be damaged by contact with harsh chemicals, detergents, sprays, perfumes, body creams, etc.

11.3. Warranty for Art Products

DinoShop.ro guarantees the authenticity of the Art Products sold on the Site. All Art Products are sold only with the artists’ consent. Art Products are covered by the statutory conformity warranty in accordance with Law No. 449/2003, so that any Product deemed non-compliant (if it does not have the same qualities and/or characteristics as described on the Site https://dinoshop.ro, does not correspond to the photographs on the Site, or does not have the qualities and characteristics stated on the invoice) may be replaced, subject to stock availability. Otherwise, DinoShop.ro will refund the value of the Product.

General Guidelines for the Display, Care, Transport, and Storage of Art Products:

- - Handling – Art Products must be handled with care to avoid damage; dropping them or subjecting them to any form of impact should be avoided.
  - Display and Storage – Art Products must be protected from moisture, extreme temperatures, and strong direct light, and kept in places where they cannot fall, be struck, or be bent (in the case of illustrations).
  - Transport – when transporting Art Products, it is recommended that each Product be individually packed using a rigid support (in the case of illustrations) and/or protective material (bubble wrap).
  - Cleaning/Washing Art Products – Art Products may be damaged during cleaning. DinoShop.ro does not recommend cleaning or washing Art Products, and any such action is undertaken at the Client’s own risk. Illustrations must be protected from any contact with liquids.
  - Contact with Chemicals – Art Products should not be exposed to any type of chemicals, detergents, sprays, perfumes, or other cosmetic products.

11.4. Warranty for Miscellaneous Products

All Products sold by DinoShop.ro that do not fall into the categories listed above (fossils, jewelry, art) are considered “Miscellaneous Products.” This category includes refrigerator magnets, keychains, magnifying glasses, books, stickers, 3D-printed objects, minerals, meteorites, etc.

Miscellaneous Products are covered by the statutory conformity warranty in accordance with Law No. 449/2003, so that any Product deemed non-compliant (if it does not have the same qualities and/or characteristics as described on the Site https://dinoshop.ro, does not correspond to the photographs on the Site, or does not have the qualities and characteristics stated on the invoice) may be replaced, subject to stock availability. Otherwise, DinoShop.ro will refund the value of the Product.

12. Product Safety Information for DinoShop.ro Products

All Products sold by DinoShop.ro (fossil specimens, jewelry, jewelry containing fossil specimens, accessories, Art Products, Miscellaneous Products, etc.) are intended exclusively for collection, display, or wear by adults, depending on the Product. Certain jewelry items, jewelry containing fossils, or fossil specimens may have sharper elements and should therefore be handled, displayed, and/or worn with care.

All DinoShop.ro Products, especially fossil specimens and jewelry containing fossils, have an educational purpose but are not toys. Certain Products are small and may be swallowed by children, may have sharper edges, or may be fragile. It is recommended that children use DinoShop.ro Products only under close adult supervision in order to avoid any injury to the child or damage to the Product.

DinoShop.ro assumes no liability for any personal injury or material damage suffered by the Client or any third party as a result of the use or mere possession of any Product sold by DinoShop.ro.

13. Information on the Origin of DinoShop.ro Fossil Specimens

All fossil specimens available through DinoShop.ro or on the DinoShop.ro Site have been legally purchased from other countries in accordance with the legislation of those respective countries, and their names and descriptions displayed on the Site are based on the specifications provided by the international dealers from whom they were purchased. They were not collected or purchased within the territory of Romania. Furthermore, no fossil specimen sold by DinoShop.ro originates from the territory of Romania, was originally collected within the territory of Romania, or forms part of Romania’s Movable Natural Heritage.

DinoShop.ro can provide all supporting documents necessary to prove the lawful origin of the fossil specimens offered for sale.

DinoShop.ro strongly supports the conservation of Romania’s Natural Heritage and does not participate in any form of unlawful removal, transfer, or disposal thereof.

14. Certificates of Authenticity

DinoShop.ro issues Certificates of Authenticity only for certain fossil specimens offered for sale. As a general rule, these certificates accompany Products whose value exceeds 100 RON; however, this is not a strict rule. The decision to provide a Product with a Certificate of Authenticity rests solely with DinoShop.ro, depending on the nature, rarity, and particular characteristics of each individual specimen.

Information regarding the presence or absence of a Certificate of Authenticity will be clearly stated in the description of each Product on the Site.

14.1. Scientific Certification

All Certificates of Authenticity issued by DinoShop.ro are reviewed and signed by the geological expert who evaluated and authenticated the specimen. The expert’s name and details attesting to their academic qualifications are stated directly on the physical certificate received by the Client. The absence of a certificate does not mean that a fossil is not authentic; it simply means that the certificate is provided as an additional benefit specifically for specimens in the premium category. For standard specimens (generally under 100 RON), a certificate may be issued upon request for an additional fee; this option must be specified in the comments/notes field when placing the Order!

The paleontological certification stated on these certificates is provided in good faith, within the limits of the geological expert’s experience and knowledge, and taking into account the scientific information available at the time of certification. Paleontology is a continuously evolving science, and classifications or names may change over time. To the extent that new international scientific discoveries arise that are relevant to the specimen purchased by the Client, this certificate may be reissued or amended by DinoShop.ro on the basis of the new scientific data.

The Client acknowledges and accepts that any reclassification, renaming, or subsequent scientific reassessment occurring after the purchase, as a result of new paleontological discoveries, is a natural part of the scientific process. Accordingly, such a change does not constitute a defect or non-conformity of the Product and cannot serve as grounds for reimbursement of the Product’s value under the conformity warranty referred to in Section 11.

14.2. Physical Condition of the Specimens

As also stated in the Certificate of Authenticity (where provided), due to the age of the specimen, the natural fossilization processes occurring over millions of years, as well as local extraction methods, the specimen may have imperfections and repaired areas (such as glued sections, reinforcements, stabilizations, restorations, etc.). These interventions and characteristics are normal, unavoidable, and specific to the field of paleontology. In accordance with the provisions of Section 11.1 of these Terms and Conditions, the Client accepts that such repairs or natural imperfections are not considered defects and may not be invoked as grounds for claiming non-conformity of the Product.

15. Articles

Within the DinoBlog section and its subcategories, DinoShop.ro maintains a free educational portal, without advertisements or any other commercial intent, accessible to any User, where it publishes relevant information from the field of paleontology (industry news, articles on paleontological topics, educational articles for children). The article texts are original, while the information sources and images used are reproduced for educational purposes, pursuant to Articles 9 and 33 of Law No. 8/1996 on copyright and related rights, without any intention of infringing the rights of the original authors or obtaining financial benefits. DinoShop.ro identifies all known authors/artists/information sources used in preparing a news item/article.

If the User notices an error or omission regarding the authors/artists/information sources mentioned in an article, the User is requested to report it to contact@dinoshop.ro so that the necessary corrections/additions can be made.

16. Disclaimer of Liability

DinoShop.ro does not guarantee that the Site, the servers on which it is hosted, or the e-mails sent are free from viruses or other potentially harmful computer components, or that they are free from errors, omissions, malfunctions, delays or interruptions in operation or transmission, line failures, or any other similar factors. The User/Client uses the Site at their own risk, and DinoShop.ro shall not be held liable for any direct or indirect damages caused by the use of or access to/visiting of the Site or as a result of using the information available on the Site. DinoShop.ro makes every effort to ensure that all information on the Site is as accurate as possible, but it cannot assume responsibility for errors or omissions that may occur in the drafting or presentation of articles, materials and/or Products and/or Services on the Site, or for any direct or indirect damages caused by them.

18. Processing of Personal Data

S.C. MI-GO CONCEPT DESIGN S.R.L., in its capacity as Personal Data Controller, processes the personal data provided directly by the User/Client, through mixed means, in accordance with these Terms and Conditions, and is exempt from the obligation to notify the processing of data for the purpose of supplying products, including for contracting, invoicing, delivery, and marketing, pursuant to Decision No. 200/2015 of the President of the Supervisory Authority, published in the Official Gazette No. 969 of December 28, 2015.

According to the legislation in force, the information and personal data or data about other persons provided when creating an account or requesting DinoShop.ro services are confidential. They are used strictly for the purpose of placing Orders, invoicing and delivery. This information is not disclosed, except in cases provided by law.

In accordance with Law No. 677/2001 on the protection of individuals with regard to the processing of personal data and the free movement of such data, Users/Clients whose data is processed have the right to information, the right to access and/or rectify the personal data being processed, the right to object at any time to the processing of personal data, the right not to be subject to an individual decision, and the right to seek legal remedies. 20. Force Majeure

Any unforeseeable and unavoidable event occurring after the conclusion of a Contract and objectively preventing, in whole or in part, the performance of contractual obligations shall be considered an event of force majeure. Neither contractual party may be held liable for the non-performance (in whole or in part) or delayed performance of its obligations if such non-performance or delay was caused by force majeure.

The parties will immediately notify each other of the force majeure event and will take all necessary measures to limit the consequences of the event.
If the force majeure event does not cease within 15 days, the parties have the right to unilaterally terminate the Contract without claiming damages.
Force majeure will be proven according to the law.

21. Dispute Resolution. Applicable Law

These Terms and Conditions constitute a Contract between the User/Client and the Seller and shall be governed by and interpreted in accordance with Romanian law. Any dispute arising between the User/Client and the Seller shall be resolved amicably. If this is not possible, the first method of dispute resolution shall be mediation, in accordance with Romanian law, and if mediation fails, the dispute shall be referred to the competent Romanian courts.

22. Updating the Terms and Conditions

DinoShop.ro reserves the right to update the Terms and Conditions at any time. It is the User’s/Client’s responsibility to regularly review the DinoShop.ro Terms and Conditions.
